Dinemap Inc. – Terms and Conditions - Canada

1. CONTRACTUAL RELATIONSHIP

These Dinemap, Inc.– Terms and Conditions – Canada (“Dinemap Terms”) govern the access or use by you, an individual, from within any country in the world (excluding the United States and its territories and possessions and Mainland China) of any platform, applications, websites, content, products, and services (the “Dinemap Services”) made available by Dinemap Inc.

Scope of these Dinemap Terms

Dinemap Services may be provided by Dinemap or, if specified in these Dinemap Terms or any supplemental terms, affiliates of Dinemap. However, the Dinemap Services provided by Dinemap under these Dinemap Terms do not include any transportation or delivery services. To the extent you request delivery services via Dinemap, the Dinemap Portier Canada Inc.-Terms and Conditions for Dinemap  (the “Dinemap  Terms”) will also apply.

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE Dinemap SERVICES.

You may accept these terms by clicking a box or by using or placing an order using an Dinemap branded application or website or by otherwise affirmatively indicating your acceptance and subsequently, by continuing to access and use the Dinemap Services, you agree to be bound by these Dinemap Terms, as may be amended from time to time, which establishes a contractual relationship between you and Dinemap. If you do not agree to these Dinemap Terms, at any time, you should not access or use the Dinemap Services. These Dinemap Terms expressly supersede prior agreements or arrangements with you and Dinemap and/or any affiliates of Dinemap regarding the provision of Dinemap Services. Dinemap may immediately terminate these Dinemap Terms or any Dinemap Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.

Supplemental terms

Supplemental terms may apply to certain Dinemap Services, such as policies for a particular event, activity or promotion, or a particular category of Dinemap Services. Supplemental terms will be provided to you in connection with the applicable Dinemap Services. You agree to abide by the Dinemap Community Guidelines, available at https://www.Dinemap.com/legal/en/document/?name=general-community-guidelines&country=canada&lang=en (the “Community Guidelines”). To the extent you access or use the Dinemap Services in connection with Dinemap Connect, you also agree to abide by the Dinemap Connect Terms and Conditions available at https://www.Dinemap.com/legal/en/document/?name=Dinemap-connect-terms-and-conditions&country=canada&lang=en, which are supplemental terms under these Dinemap Terms.

Any supplemental terms and policies, including the Community Guidelines, are in addition to, and shall be deemed a part of, the Dinemap Terms for the purposes of the applicable Dinemap Services. Supplemental terms shall prevail over these Dinemap Terms in the event of a conflict with respect to the applicable Dinemap Services. For clarity, the Dinemap  Terms accepted by you are not supplemental terms, but rather a separate agreement between you and the Dinemap affiliate identified in the Dinemap Terms.
